How to File an RDC Conciliation Agreement for a Dubai Tenancy

•7 min read•Article•Leonid Gorok

The main points in 30 seconds

After the conciliation session, Register Dispute Lawsuit - Amicable Settlement issues a paper named Agreement or Waiver. If the parties settled, that paper is the conciliation agreement, signed by the parties and the conciliator and approved by a supervising judge. The Rental Disputes Center can enforce it. If the claim was waived, the paper is the waiver received through the website. Store that copy with the tenancy it settles. A chat that says the parties agreed is not the file.

The conciliation session is over. The paper to file is Agreement or Waiver from Register Dispute Lawsuit - Amicable Settlement at the Dubai Rental Disputes Center (RDC). The last step is to sign and receive the conciliation agreement, or waive the claim, through the website. A chat that says the parties agreed is not that paper. The latest Ejari — Dubai's registered tenancy contract — that opened the service is not that paper. The copy that belongs on the tenancy is the one the service issued.

The paper after the session

Register Dispute Lawsuit - Amicable Settlement lets the parties file a conciliation so they can reach a settlement away from litigation, inside a legal framework. The English service card names the issued document Agreement or Waiver. It also says there is no service form. When the parties settle, the conciliation is signed by the parties and the conciliator and approved by a supervising judge. The card says that agreement can be enforced at the Rental Disputes Center.

On both the trustee path and the website path, the last step comes after the session. On the trustee path it is the sixth step. On the website path it is the fifth. Both say to sign and receive the conciliation agreement, or waive the claim, through the website. Parties attend that session through the tele-litigation system. The card names two channels: the RDC website and Real Estate Services Trustees Centers.

If the claim was waived, the paper to keep is the waiver received through the website. Agreement or Waiver is the card's name for that issued document, whether the parties settled or the claim was waived. Keep the one the service issued. A letter the parties wrote with no centre is not that waiver.

The copy sits on the reconciliation file. The English FAQ says to log in, search for the reconciliation file, and open the Agreements button to view or print the reconciliation agreement. The page you view or print is the copy that goes on the tenancy. There is no second form.

Store the agreement or the waiver with the tenancy it settles. A scan that does not name the unit is not the file. The pages can look finished and still belong to the wrong apartment. A chat that says the parties agreed can stay in the thread, and it is still not Agreement or Waiver. The latest Ejari from the opening upload remains the lease copy used to register the service.

Rental Disputes Center services are accessed at rdc.gov.ae. The migration note says they are no longer available through the Dubai Land Department website. The live English card for this service is the page that names Agreement or Waiver.

Checklist of the agreement or waiver issued after the session

These papers are other services

The services index lists Register Dispute Lawsuit - Amicable Settlement above the Lawsuits heading. Under Lawsuits it lists Register First Instance Lawsuit (Rental). Under Execution it lists File an Execution — Cheques and Register an Execution Proceeding - Rental. The index keeps those names as separate services. The first-instance upload, the bounced-cheque execution file, the unpaid-rent demand, and a private early-exit letter each stay on their own page.

Checklist of papers that stay off the conciliation file

Not the issued agreement

Register First Instance Lawsuit (Rental) is a different service, and a decision during a first-instance session that refers the case to conciliation is not this paper. File an Execution — Cheques is a different service, and a cheque named only as support when the claim was opened is not the execution file and not this agreement. The unpaid-rent demand and proof it was served is its own file and stops before a case. A mutual early-exit letter the parties sign with no centre is not this issued document. A waiver or settlement request inside an execution file, submitted from the electronic requests box, is a different request from the waiver received through the website after this session. The opening upload registered the service and is not Agreement or Waiver. It holds the latest Ejari and a bank letter or statement mentioning the plaintiff's IBAN — the international bank account number — plus an Emirates ID for a person or, for a company, a copy of the commercial licence and a copy of the manager's or owner's photo ID. Only an eviction claim adds the notarised notice, which the card spells Notorised, with the notification officer's report, or registered post with the receipt of notice acknowledgement. Supporting papers such as a power of attorney, a management contract, correspondence, notices, electricity and water bills, cheques, and letters can be added when the claim is opened. Those sheets are not the paper stored after the session.

Store the copy, then stop

Once the session is over, file the issued paper in this order. The tenancy comes first, then Agreement or Waiver from the reconciliation file. Other papers stay on their own files.

Checklist for storing the issued copy with the tenancy
  1. Name the tenancy

The agreement belongs to one tenancy. Name that unit before the scan is saved. If the pages do not name the unit, stop. A loose scan is not the file.

  2. Keep the paper from the session

After the conciliation session, keep the paper the service issues. If the parties settled, that paper is the conciliation agreement signed by the parties and the conciliator and approved by a supervising judge. The service card says that agreement can be enforced at the Rental Disputes Center. If the only record is a chat that says they agreed, stop.

  3. Keep the waiver when the claim was waived

If the claim was waived, keep the waiver received through the website. The issued document on the card is Agreement or Waiver. A letter the parties signed with no centre is not that waiver.

  4. Take the copy from the Agreements button

Search for the reconciliation file and open the Agreements button. View or print the reconciliation agreement there. Store that copy. The service card says there is no form for this paper.

  5. Leave the opening upload with the registration

The latest Ejari, the identity page or the company licence, and the plaintiff's IBAN letter registered the service. The notice pair is added only when the claim is an eviction. Those sheets are not Agreement or Waiver.

  6. Leave the other files alone

If the chat holds the first-instance upload, a returned cheque, or only the unpaid-rent demand and proof it was served, stop and leave those files. Do not open an execution file in this set. The FAQ says an enforcement file can be opened later if there is an agreement. Opening that file is a different job.

  7. Store the copy on the tenancy

Put the conciliation agreement, or the waiver, on the tenancy it settles. The copy should name the unit. Then stop.

Stop when the named tenancy holds the signed conciliation agreement, or the waiver if the claim was waived, and the copy names the unit. This article does not state the fee, and the live English service card is where that schedule sits. IziRento stores the agreement or the waiver and does not file the case, attend the session, or sign the agreement. It is not a landlord, a broker, a lawyer, or a party to the lease, and identity numbers from the upload stay out of the workspace.

Store the agreement with the tenancy

Keep the signed conciliation agreement or the waiver on the tenancy record.

Open the workspace

After the RDC session, file the signed conciliation agreement or the waiver on the Dubai tenancy it settles, and leave the other papers aside.
