The problem is that volunteered six months before both sides have signed is still a breach. GOV.UK’s local-authority guide, updated 8 May 2026: a tenant offers six months now to secure the property; the landlord accepts, then they sign — a breach, because the offer was accepted before the tenancy was entered into. Typical mistake: keeping Thursday’s transfer “and we’ll call it month one after we sign”.

What to do if six months land before anyone signed?

No. Rent payable before the tenancy is entered into is a prohibited payment on a new assured tenancy in England. You must not invite, encourage or accept it, even if they volunteered it. Send Thursday’s transfer back and file the repayment date and amount.

Do return the £7,200 the same week it lands. Renters’ Rights Act 2025 s.9, in force 1 May 2026: you must not invite, encourage or accept rent before the tenancy is entered into, including via a third party. GOV.UK fees, updated 7 July 2026: if they offer rent before the agreement is signed, you must not accept it. Do not keep it because they have no UK guarantor.

When to take the first-period payment after signing?

Both landlord or agent and tenant must have signed before any rent is due. Asking for the first month to clear before you will sign is a breach. Date the agreement first. Then take the initial rent in the window before the start date.

Do not write “sign when the funds clear”. In practice, Edie should have dated Friday’s signatures, then asked for one labelled first-period receipt, not waited on Thursday’s lump. The permitted pre-tenancy period — from when both sides have signed to the day before the tenancy starts — is the only window for that first ask. How much rent can you take the day after you both signed?

Which slip holds the holding deposit before signing?

A holding deposit — up to one week’s rent taken to reserve the let — is allowed before anyone has signed. It is not rent. Keep Thursday’s week on its own slip: amount, date received, advertised rent. Do not mix it with the £7,200.

Do keep that week on the holding-deposit record. GOV.UK: before signing you can ask for a holding deposit and a tenancy deposit. Housing Act 1988 s.4B(8) lets it pay initial rent in the permitted pre-tenancy period, only with the payer’s written yes after both have signed. Two money tabs, two labels.
