Key takeaways

After the date on a possession notice for a privately rented home in England has passed and the tenant is still there, assemble Form N5 with Form N119, or use Possession Claim Online only for a rent-only claim. Attach the already-served notice and service details, pay the county-court possession issue fee printed on GOV.UK, and file with the extra copies the court needs. Stop before any warrant forms.

The date in the possession notice has passed and the tenant is still there. This page is the county-court claim pack: Form N5 with Form N119 for a rented residential property in England, not another Form 3A. Serving the section 8 notice is the earlier file; this pack starts only after that notice period ends.

This pack starts only after the notice expires

GOV.UK’s repossessing guidance for privately rented property in England says that if the tenant does not leave by the date in the section 8 notice, you apply to the court for a possession order. The notice itself — Form 3A or substantially to the like effect — belongs in the earlier serve file. Start here only when that notice is already served, the period has ended, and the tenant remains at one privately rented address in England.

If the home is outside England, stop here and use the forms and court route for that jurisdiction; the England N5 and N119 pair on GOV.UK is not the Wales pack. Ground 1A sale-intention evidence, an accelerated Form N5B claim, and a bailiff warrant (Form N325 / N325A) are separate stages from this filing. For rent arrears that are still a workflow before any court claim, keep the first-30-days arrears file and any repayment-plan record separate from the claim pack.

The standard possession orders guide uses the same split as the repossessing page: Possession Claim Online when the claim is only for rent, otherwise paper N5 and N119 to the local court that deals with housing possession. Choose that route before you fill any forms.

Do: use Possession Claim Online only when GOV.UK allows a claim for unpaid rent (or mortgage as the PCOL page states) and no other reason.

Don’t: treat Possession Claim Online as the default for every section 8 claim. Sale, breach, and other non-rent grounds stay on paper N5 and N119.

Confirm the stage, then choose the filing route

If the section 8 notice is not yet served, or the date on it has not passed, stop. Finish the Form 3A serve file first; this pack is not a second notice. If the claim is only for owing rent (or mortgage as Possession Claim Online allows) and no other reason, the online service may apply. For any other section 8 reason, prepare paper Form N5 and Form N119 for the county court that covers housing for the property. IziRento stores the pack; it does not file at court, take the fee, or appear at the hearing.

Build the claim pack in filing order

Download the current England versions of N5 and N119 from GOV.UK. After 1 May 2026 HMCTS refreshed those forms; older PDFs risk being returned unissued. Complete the claim form and the particulars with the tenancy, the grounds, and the relief sought. Include a copy of the notice already served and, if you record who was served, how, and when, add Form N215. Attach evidence that matches the grounds already on the notice — for example a rent history for arrears — following what the repossessing guide and the forms ask for, rather than a borrowed checklist from another claim.

The county-court possession issue fee is £415 on the Civil court fees (EX50) line for issuing a possession claim, on the repossessing guide, and on Possession Claim Online. Check EX50 on the day you file. Payment routes the repossessing page names include cheque to HM Courts and Tribunals Service, card by phone or at the counter, or a fee account if set up. Help with fees, where eligible, is a paper path — PCOL is not available if you are applying for help with fees.

Assemble and file the pack

  1. Confirm the notice period has ended

Check the date on the served section 8 notice and that the tenant has not left. If the notice is unserved or the date has not passed, stop and finish the Form 3A serve file instead of starting court forms.

  2. Choose paper N5/N119 or Possession Claim Online

Use Possession Claim Online only for unpaid rent (or mortgage as that GOV.UK page allows) with no other reason. Otherwise prepare paper Form N5 and Form N119 for the county court nearest to, or covering housing for, the property.

  3. Complete the current England forms

Download the England Form N5 claim form and Form N119 particulars of claim from GOV.UK. Fill in the tenancy, grounds, and relief sought. Keep Form N119A notes to hand if you need the accompanying guidance.

  4. Attach the notice, service details, and matching evidence

Include a copy of the section 8 notice already served. Add Form N215 if you are recording who was served, how, and when. Attach evidence that matches the grounds on the notice. Sale-intention papers for Ground 1A stay in their own evidence file if you already built one.

  5. Pay the possession issue fee printed on GOV.UK

Pay the county-court possession claim issue fee as printed on EX50, the repossessing guide, and PCOL (£415 on those GOV.UK pages). Recheck EX50 on the filing day. Leave warrant fees out of this pack.

  6. File with extra copies and diary what comes next

Post, email, or deliver to the court. Email filing, where used, is one email only, not bigger than 10 megabytes including attachments, and not longer than 25 pages when printed. Give the court at least one extra copy of each document for the tenant, plus another for each joint tenant, and keep your own copies. Diary the notice of issue, claim number, the defence window (14 days from service of the claim papers), and the requirement to send case documents to the court at least 14 days before the hearing. Do not add Form N325 or bailiff steps here.

After issue, the court sends the papers to the tenant and sends you a notice of issue with the claim number and a hearing date. Defence drafting and hearing preparation come later. You are done with this stage when the pack holds the completed England N5 and N119 (or the PCOL filing when that route applies), the served notice copy, service details, matching evidence, the issue-fee payment trail from GOV.UK, and the extra copies for filing — and when you have diaried the notice of issue and the claim number.

Check the Civil court fees (EX50) possession-issue line on the day you file. Leave warrant fees, Form N325, bailiffs, and High Court writ practice for later. IziRento stores the pack and does not file at court, take the fee, or appear at the hearing.

FAQ

Can I file the claim before the date on the possession notice?

No. The repossessing guidance and the standard possession orders page both start the court application after the tenant has not left by the date in the notice. Wait out that date, or finish serving Form 3A if the notice is still outstanding.

When can I use Possession Claim Online instead of paper N5 and N119?

When the claim is only for unpaid rent (or mortgage payments as the Possession Claim Online page allows) and no other reason. The N5 and N119 pages and the repossessing guide send every other section 8 reason to paper forms. You also cannot use PCOL if you are applying for help with fees.

Which particulars form sits with Form N5 for a rented residential home?

Form N119. GOV.UK pairs N5 with N119 for rented residential property, N120 for mortgaged residential property, and N121 for trespassers. This pack is the rented pair only.

What court fee do I pay for this pack?

Pay the county-court possession claim issue fee printed on Civil court fees (EX50), the repossessing guide, and Possession Claim Online. On those GOV.UK pages the figure is £415. Recheck EX50 on the day you file. Warrant of possession fees belong to later enforcement, not to this claim filing.

What do I attach from the earlier Form 3A file?

A copy of the section 8 notice already served, and enough to show it was given correctly — including Form N215 or equivalent service details if you used them. Do not redraft Form 3A here. Evidence already held for the grounds on that notice can ride as attachments; sale-intention papers for Ground 1A stay in their own file if you have one.

Is assembling N5 and N119 the same as serving Form 3A?

No. Form 3A is the possession notice served before any claim. N5 and N119 (or PCOL for rent-only) are the county-court claim after that notice period has ended and the tenant is still there. They are consecutive stages, not interchangeable forms.

After the possession notice expires in England, assemble Form N5, Form N119, the served notice, evidence and the GOV.UK issue fee for county court.
