
How to File a Mutual Surrender When a Tenant Wants to Leave Before Notice Runs

The problem is that nobody named every joint tenant, or wrote one end date and time. Handing the keys back does not end the tenancy. Shelter Legal, last updated 1 May 2026: keys through the letterbox are only the tenant’s offer of surrender — a voluntary agreement that the tenancy has come to an end. You are not bound to accept (Laine v Cadwallader). Typical mistake: treating Friday’s porch keys as the end.

How do you take the leave-early request and every named tenant’s yes?
Save the leave-early message as received, with headers or a timestamped screenshot, not a paraphrase. “Can I go Friday” is a request to agree an earlier end. Get a written yes from every name on the live agreement and from you. A silent partner or a thumbs-up from one of two names is not the file.
Do file the WhatsApp or email as it landed. GOV.UK for landlords: you can agree to end the tenancy earlier — in writing. Shelter Legal on joint tenancies (1 May 2026): a joint tenancy is only surrendered where each of the joint tenants agrees (Leek and Moorlands Building Society v Clark). One named person cannot surrender for the others.
In practice, Hester should have saved Tuesday’s thread and emailed both names: do you agree Friday 17:00? Do write their yes. If they have already served a valid two-month notice and want to bring that date forward, keep the original on the tenant notice intake card and still run this tab for the new agreed date. Pressure to hand keys tonight is not a reason to skip that yes.

What to write as the end date and time instead of “when they move”?
Write Friday 17:00, or the actual hour keys and possession change. Shelter England, last updated 17 July 2026: agree a tenancy end date and move out by that day. “When you’ve emptied it” is not a date. Rent-to-date is calculated to that stamp, not to whenever the van left.
Do write the hour. After 1 May 2026 most private assured shorthold tenancies became assured periodic tenancies — rolling, with no fixed end date. The live question is whether they leave before two months’ notice would run. GOV.UK’s Renters’ Rights Act overview: you and the landlord can agree to end earlier, in writing. Shelter on ending a periodic tenancy says the same.
Do not leave the time blank because “they’ll be gone by the weekend”. Hester’s Thursday listing had no stamp to point at.

How do you plan keys, rent-to-date, and the deposit-scheme tab?
Open the existing key list and write what comes back on the end date and time. Write the last rent day — they keep paying until the tenancy ends unless you agree otherwise. Name the Deposit Protection Service, mydeposits or the Tenancy Deposit Scheme as which tab the repayment will use.
Do count keys against the list you already keep. Open the keys and fobs handover file and write the set back on Friday 17:00. Diary the rooms walk on the tenancy check-out report — do not rebuild that checklist here. Rent-to-date is one line; the running row lives on the rent schedule.
For example, write “TDS — repayment from Friday 17:00” on this tab, then follow the deposit repayment process once you agree the figure. GOV.UK tenancy deposit protection: return the deposit within 10 days of agreeing how much they get back.
When to accept early keys — and when can you re-let?
Keys through the letterbox are an offer, not an end. Accept or reject in writing the same day. If you accept, the tenancy ends at that stamp and rent stops. If you reject, the tenancy and rent still run to the written date and time. Do not list the let until the file says the tenancy has ended.
Do write which. Shelter Legal: implied surrender needs an unequivocal act by both sides. LettingAProperty, updated 7 July 2026: advertising, viewings, a new holding deposit, or changing the locks can be treated as acceptance. Count the keys against the existing list on the day they arrive, even if check-out is later.
Do not change the locks or start non-urgent works while the tab still says they occupy. Protection from Eviction Act 1977 s.1 makes it an offence to unlawfully deprive a residential occupier of occupation. Hester listed on Thursday. Write accept or reject before anyone views. The risk is a holding deposit sitting on a let that never ended.
Porch keys are an offer
Accept or reject in writing the same day. Do not list the let or change the locks until the file says the tenancy has ended.

Where does the early-end tab live?
Clip six lines in the tenancy folder: the written request, every named-party yes, one end date and time, the key decision, rent-to-date, and the deposit-scheme tab. Label it early-end-YYYY-MM-DD. That is the file you open before anyone re-lets.
Do file the clip next to the live agreement in the tenancy agreement folder. Workflow: request → named-party yes → one date and time → keys, rent-to-date and scheme tab → same-day accept or reject if keys come early → clip the tab. What if one joint tenant will not sign?

Can I charge a re-let fee if they asked to leave early?
Only up to your loss under Tenant Fees Act 2019 Sch.1 para.7. GOV.UK fees (7 July 2026): not more than the rent you would have received if they had given the right notice. You do not have to charge. A flat admin fee above that is a prohibited payment.
Can we agree an earlier end than two months’ notice?

What if they have already served a two-month notice and want Friday instead?
