Key takeaways

After 1 May 2026, England private landlords seeking possession use Form 3A — a section 8 notice. Complete questions 1–5 with full Schedule 2 wording in 4.2 and your explanation in 4.3, serve by the tenancy method or a guidance method, keep a copy per named tenant plus N215 or the dated “served by…” line, and diary question 2.1 with the normal 12-month validity. Stop before any claim pack.

Before any possession claim for one privately rented assured tenancy or assured agricultural occupancy in England, complete and serve the current Form 3A, file proof of service, and diary question 2.1 plus the normal 12-month validity. That is the Form 3A serve file — not the later N5/N119 claim pack, and not a Ground 1A sale-intention evidence pack.

Since 1 May 2026, private landlords in England seeking possession use a section 8 notice — Form 3A on the assured tenancy forms page. Form 3 on that page is for social housing only. Form 6A and section 21 remain only for notices served before 1 May 2026, not as today’s private route. GOV.UK’s repossession guidance says the same: after that date, private landlords cannot use section 21 to seek possession.

Do use the current Form 3A (or a form substantially to the like effect) with the full Schedule 2 wording pasted into question 4.2. Do not put social Form 3, Form 6A, or a section 21 template into this private file for a notice you are serving now. If the home is outside England, stop — this file is England-only.

If you rely on Ground 1A, keep the sale-intention evidence with that ground rather than mixing it into the notice serve steps. County-court claim forms start only after the notice period ends. A rent increase is a different notice — the Section 13 Form 4A serve file — and early arrears chasing stays on the first-30-days arrears log.

Private landlords use Form 3A, not Form 3

The Form 3A PDF (05.26) is titled for an assured tenancy or assured agricultural occupancy in the private rented sector in England. It cites Housing Act 1988 section 8, as amended, and tells social-sector landlords to use Form 3 instead. SI 2026/354 regulation 3 makes that Form 3A (or a form substantially to the like effect) the prescribed private section 8 notice.

For the notice to stand on the repossession page, use Form 3A or a form substantially to the like effect, give the right amount of notice, and set out fully the substance of each ground plus why it applies. An incomplete or inaccurate notice can mean a later claim is dismissed or delayed.

Stop-checks before you fill Form 3A

If the property is social housing, use Form 3 — not Form 3A. If you only need a rent increase, stop and use Form 4A. If a breathing space covers rent arrears, do not serve on grounds 8, 10 or 11, and do not start a new rent-arrears claim on an already-served notice, unless a court has given permission, as the Form 3A landlord guidance states. That guidance prints a standard breathing space of up to 60 days, and a mental-health crisis breathing space lasting for the treatment plus 30 days.

Build the Form 3A serve file in order

The file for one England private address is the completed current Form 3A, a copy for each named tenant, proof of how and when it was served, and a diary of question 2.1 plus the normal 12-month validity from service. The Form 3A Guidance for landlords is the service and proof companion. IziRento stores that file; it does not serve Form 3A, complete N215, or file a claim.

Complete, serve, and prove Form 3A

  1. Confirm the let and the grounds

Confirm this is an England privately rented assured tenancy or assured agricultural occupancy after 1 May 2026, and that possession will rest on one or more Schedule 2 grounds. If you only need a rent increase, stop at Form 4A. If the house is social housing, Form 3A is the wrong form.

  2. Download the current Form 3A and guidance

Take Form 3A and the landlord guidance from the assured tenancy forms page. Do not use Form 3, Form 6A, or a section 21 template for a notice you are serving now. SI 2026/354 also allows a form substantially to the like effect — meaning the same substance as the published Form 3A, not a homemade substitute.

  3. Complete questions 1–5 with full legal wording

List every joint tenant in 1.1 and the address in 1.2. In 4.2 paste the full Schedule 2 wording from Form 3A: Legal wording for possession grounds — not the ground name alone. Complete 4.3 with the factual explanation. Set 2.1 from the official table (day after the period expires; longest period if several grounds, unless 7A or 14). Short checks: Grounds 1 and 1A cannot ask the tenant to leave inside the first 12 months of a new tenancy (4 months’ notice each); some grounds need prior notice at the start; for most grounds deposit rules on the repossession page must be met (not for 7A or 14). Worked illustration: Ground 8 needs at least three months’ rent unpaid if monthly (or thirteen weeks if weekly or fortnightly) at service and at the hearing, Universal Credit delay amounts ignored, and four weeks’ notice.

  4. Sign, copy, and serve

Sign and date sections 5.1–5.7 (joint landlords add signatures). Keep the original. Give a copy to each tenant named in the tenancy agreement. Serve by the method named in the written tenancy agreement. If none is named, the landlord guidance lists: give it in person; deliver it to the property and, if needed, post it through the letterbox; or send it by registered post. Email only if the written agreement clearly allows email service.

  5. File proof and diary the dates the same day

Fill Form N215, or write “served by [name] on [date]” on the notice. Diary 2.1 and the normal 12-month validity from service. If the notice is based on rent arrears and the tenant is in a breathing space, the Form 3A guidance says validity may be extended by another 8 weeks after the breathing space ends, in the circumstances it sets out.

  6. Stop before the claim pack

If the tenant remains after the notice period, the next job is the N5/N119 claim pack — not this file. Do not put claim-stage fees, PCOL steps, or warrant forms here. Keep Ground 1A sale-intention evidence with that ground when you use it.

Pin question 2.1 to the official notice-period buckets

The notice period begins on the day the notice is served. The tenant does not have to leave during that period. Question 2.1 must be the day after the relevant notice period expires. Housing Act 1988 section 8(4AA) and the Form 3A landlord guidance print matching buckets. If you rely on more than one ground, wait for the longest period unless you are using grounds 7A or 14, when the court can be applied to immediately after serving.

The landlord guidance works an example: Ground 8 (four weeks) and Ground 7 (two months) served on 1 June 2026 gives an earliest court application of 1 August 2026. The table below is those official buckets only — not a claim-fee schedule. The £415 possession-order fee belongs to the later claim stage, not to Form 3A.

What the finished file holds

Stop when the file holds the completed current Form 3A for this address (full legal wording in 4.2 and explanation in 4.3), a copy for each named tenant, proof of how and when it was served (Form N215 or the dated “served by…” line), and a diary of question 2.1 plus the normal 12-month validity from service. GOV.UK’s giving-notice page repeats those two proof options. Leave the N5/N119 claim pack until after the notice period ends, and keep Ground 1A sale evidence with that ground. Do not put social Form 3, Form 6A, or section 21 into this private file for a notice served now.

Deposit scheme references stay with the deposit scheme reference file when you need them for readiness checks; they are not Form 3A fields. IziRento stores the Form 3A serve file and does not serve the notice, complete N215, or file a claim. You can keep the completed form, the service note or N215, and the 2.1 / 12-month diary in a workspace.

FAQ

Which form do private landlords use after 1 May 2026?

Form 3A — also known as a section 8 notice — for a privately rented assured tenancy or assured agricultural occupancy in England. Form 3 is for social housing. Form 6A and section 21 are not today’s private route for a notice served now.

What if email is not an agreed service method?

Follow the written tenancy agreement first. If it names no method, the Form 3A landlord guidance lists in person, delivery to the property (including through the letterbox), or registered post. Email only if the agreement clearly allows it. Keep N215 or the dated “served by…” line either way.

What do I keep if I rely on more than one ground?

Keep the completed Form 3A with full wording for each ground in 4.2 and the explanation in 4.3, a copy per named tenant, and proof of service. Set 2.1 from the longest period among those grounds, unless using 7A or 14. Diary 2.1 and the normal 12-month validity. When you complete 4.2, take the wording from Form 3A: Legal wording for possession grounds.
