How to Keep a Lease Brokerage Agreement Between Owner and Broker in Dubai

•8 min read•Article•Leonid Gorok

The main points in 30 seconds

The lease brokerage agreement between the owner and the broker is Dubai Land Department form No.1, issued in August 2022. The broker office is the first party and the owner is the second. Page 2 carries the start date, the end date, and the Exclusive and Non-Exclusive boxes. File the signed copy on the unit before the unit is advertised, and leave the commission lines as the two parties wrote them.

Before a Dubai unit is advertised, the signed lease brokerage agreement between the owner and the broker belongs on that unit. The exclusive or non-exclusive mark is made on that same sheet. A sale marketing contract between a seller and a brokerage is a different paper. The copy kept with the unit shows the ticked box and the dates as they were written.

The Dubai Land Department still publishes Lease brokerage agreement between the owner and broker, a 943 KB PDF labelled 25 August 2022. The header reads LEASE BROKERAGE AGREEMENT BETWEEN THE OWNER AND BROKER. Each page carries the code DLD/RERA/RL/LP/P210/ No.1/Vr.4, issue date August 2022, on the owner-and-broker form. Saying the listing is exclusive does not mark either box.

Form No.1 on the unit before advertising

Page 1 of form No.1 records the parties and the property. The owner block takes the name, mobile, phone, Emirates ID where it applies, address, and email. The broker block takes the office registration number (ORN), company name, commercial licence number, broker name, broker registration number (BRN), phone, address, and email. Those lines name the office appointed on this sheet.

The property block asks for status, plot and area, and a type such as villa, apartment, shop, office, warehouse, or other. It also asks for the area, the Makani ID (the location number), the use, the project name, and the approximate rental budget the parties wrote. Building number, owners’ association number, car parks, and services sit on the same block. For example, a budget figure stays only if the parties have already written it.

Page 2 is where the dates, the commission lines, and the signature blocks sit. Each signature block asks for name, title, date, signature, and stamp, once for the broker office and once for the owner. Page 3 carries only the form code. Both signature blocks need to be signed before this copy is the sheet you file on the unit.

Circular (21-2016), dated 18 December 2016, asked brokers in leasing to use the approved real estate forms. The rules index still groups three leasing PDFs under Leasing Brokerage Agreement, each labelled 25 August 2022. Form No.2 is the broker-and-tenant lease brokerage agreement, and it has no Exclusive or Non-Exclusive boxes. Form No.3 is the property viewing agreement between the broker office and the tenant, kept as its own sheet. The sheet kept for this unit’s advertising authority is form No.1.

A signed addendum changes an existing lease, and that page is a different file. Form No.1 is between the owner and the broker, and it is in place before the unit is advertised. It stays with the unit. Pasting it into the addendum mixes two files.

Article 26 of Bylaw No. (85) of 2006 requires a brokerage agreement in writing. The writing names the parties, the property, and the brokerage terms. The same article says the agreement is entered in the record of the Real Property Register. The English compilation notes that Arabic prevails. A copy of the title deed is not this written agreement.

The exclusive mark sits on page 2

Turn to page 2 after the property block. The start date and the end date are printed there, above two boxes labelled Non-Exclusive and Exclusive. The ticked box is the mark for this unit. Something said in conversation does not replace that tick.

Article 27 of the same bylaw says the broker’s remuneration is set by agreement. If there is no agreement, it refers to prevailing practice and does not describe that practice. On the form, the owner line and the tenant line are blank, each ready for an amount in dirhams or a percentage.

The boxes and the blank lines

The Exclusive and Non-Exclusive boxes sit on page 2 of form No.1, with the start date and the end date. On this sheet, open means the Non-Exclusive box. There is no third box, and this pair is not a setting on a sale contract. The form prints no number of days and no cap on how many brokers may be appointed. The owner line and the tenant line stay as the parties wrote them. The form prints no percentage, no flat fee, and no VAT.

Contract A is the sale marketing contract

The November 2024 guide defines Contract A as the seller’s marketing agreement with the brokerage. The Real Estate Brokerage Practice Guide puts that definition in its section on smart marketing and sales contracts. Contract B is the buyer’s wish to purchase, made with the broker. Contract F is the agreement to sell between the seller and the buyer. None of those three is form No.1. An owner does not sign a sale contract in order to let the unit.

Circular (2022-01), reference DLD/OUT/2022/0004440, is dated 14 July 2022. From 1 August 2022, Form A is linked to the real estate permit system. A marketing agreement that a broker and a seller sign can be completed online as Form A. That seller paper is not the lease brokerage agreement between the owner and the broker.

Article 28(2) of Bylaw No. (85) of 2006 speaks of remuneration when the sale contract is signed and registered with the Department, unless the brokerage agreement says otherwise. Those words describe a sale. It does not say commission is due when Ejari, Dubai’s tenancy registration, is completed. The Ejari registration documents are the tenancy file. This brokerage sheet is not that file, and it is not the lease with the tenant.

The ORN, the commercial licence number, and the BRN identify the office on form No.1. Article 12 says the broker card shows the name, address, and registration number. That name and number also appear in the broker’s correspondence. The company trade licence and signatory documents are their own file. A mutual early-exit settlement is a mid-tenancy paper, and unused cheques or a deposit line belong there. An advertising permit is a different file, and the permit service asks a broker applicant for a marketing-contract copy with the owner.

Store the signed copy before advertising

With Contract A set aside as the sale paper, form No.1 is the file that goes on the unit. The order below covers the header, the property block, the dates, and the box. The signed copy is stored before the unit is advertised. Neighbouring files stay in their own places.

Filing order for this sheet

  1. Check the PDF header

The header should be the lease brokerage agreement between the owner and the broker, form No.1, issue date August 2022. Both signature blocks need a signature. If the file is Contract A, set it aside. It is not this sheet.

  2. Match the property block

Compare type, plot or area, project, and building with this unit. Keep the approximate rental budget only as the parties wrote it.

  3. Read the two dates

The start date and the end date on page 2 are the whole term. The form prints no day count.

  4. See which box is marked

Confirm Exclusive or Non-Exclusive on the same page as those dates. That mark is the listing authority kept on this owner-broker sheet.

  5. Put the signed copy on the unit

Store the signed owner copy with the unit before the unit is advertised.

  6. Leave the neighbouring files

A lease addendum, the company licence pack, the Ejari registration file, and any early-exit settlement stay in their own files. If another leasing form is already signed, keep it as its own sheet. No fee is written on this sheet.

  7. Leave the commission lines

Both commission lines stay as the parties wrote them, including a line left blank. IziRento stores the signed agreement. It does not pay the broker.

The sheet is filed when the signed copy is on the unit, one box is marked, and the dates match the page. Leave the commission lines and the dates as written, with no percentage, flat fee, VAT, day count, or broker limit added. Form A, a lease addendum, the licence pack, the Ejari file, an early-exit settlement, and an advertising permit each stay separate. IziRento stores the signed agreement and does not pay the broker.

Keep the signed sheet on the unit

IziRento stores the owner-broker agreement with the unit. It does not pay the broker or issue a permit.

Open the workspace

File the signed owner-broker lease sheet on the Dubai unit before advertising, with the exclusive or non-exclusive mark and the dates left as written.
