The problem is treating piled post and one missed rent as proof the tenancy has ended. Typical mistake: change the locks, then learn the tenant was in hospital and you have no contact log.

In England, “abandonment” has no specific legal meaning, and an abandonment notice on the door has no legal standing — it does not end a tenancy. Shelter Legal (1 May 2026) is plain on both. There is still no private-landlord statutory shortcut to change the locks: Housing and Planning Act 2016 Part 3 never commenced and was omitted by Renters’ Rights Act 2025 section 59 from 27 December 2025.

When to open the investigation tab?

Open it the day rent stops or emptiness is reported — not when silence finally feels permanent. Write the trigger: missed rent date, neighbour report date, or both. That stamp separates “we are still investigating” from “we assumed they had gone”.

Do not wait for a gut feeling. Sheffield City Council: even if you think they have left, you cannot simply re-enter and change the locks — they may be in hospital or prison. Protection from Eviction Act 1977 section 1 makes it an offence to unlawfully deprive a residential occupier unless you believed and had reasonable cause to believe they had ceased to reside. The investigation tab is that trail. From 1 May 2026, councils may impose a civil penalty of up to £40,000 (GOV.UK). Don’t treat piled post as the end of the tenancy.

How do you log every contact attempt?

Attempt contact on every channel you hold and write each try with date, method and result. Phone, text, email, letter to the property, any forwarding or “after tenancy” address, plus the emergency contact and guarantor if they are on the AST. A single WhatsApp “anyone home?” is not the file.

Do keep copies of letters, texts, messages and call notes. LettingAProperty (14 July 2026) lists the build: rent statement, letters, emails, neighbour notes, utility enquiries where available. CIA Landlords (25 July 2025): get neighbour reports in writing where you can, and treat any letter you leave as an invitation to contact — not a termination. Don’t rely on a door “abandonment notice” as a possession order.

What to photograph after an access notice?

Inspect only after a proper written access notice for a non-emergency visit. Photograph the exterior — post pile-up, bins, garden, windows — and, if you lawfully access, the interior: remaining belongings, fridge sell-by dates, meters if visible. Leave goods where they are. Do not force entry or change locks on this visit.

Dated photos of post, belongings and meters are evidence. Binning the fridge mid-investigation is not. Leave goods where they are until a lawful end.

What to do if they answer — or stay silent?

Branch on the contact log. If the tenant answers and wants an agreed early end, get that leave request in writing and switch to the mutual-surrender file. If they stay silent, keep the log for advice on possession — do not treat silence as a DIY lock change.

Do hand an answering tenant who wants out to the mutual surrender early-end file. Shelter Legal: leaving without notice, even with rent owing, is not automatic surrender. In Wren’s case the tenant later emails from a hospital ward. The contact log and dated photos are the file. A Saturday lock change would have been the unlawful-eviction risk.

How to file the investigation tab?

Clip one tab in the tenancy folder: trigger date, contact log, access-notice proof, dated photos, and a branch note — agreed end, or silent and seeking advice. Label it abandonment-investigation-YYYY-MM-DD.

Do file the clip next to the live agreement in the tenancy agreement folder. Workflow: trigger → contact log → access notice then photograph without force → branch to agreed end or keep for advice → clip the tab. FAQ

Does piled-up post mean I can re-let?

No. Post pile-up is one signal to photograph and date. Shelter Legal: leaving without notice does not automatically end the tenancy. Sheffield: do not change locks or re-let on suspicion. Re-letting while the tenancy is live risks unlawful eviction under PEA 1977 section 1.

What if keys appear in the letterbox with no letter?

Keys through the letterbox are an offer of surrender, not an automatic end (Shelter Legal; Laine). Do not change the locks on that alone. If they also want to leave, run the mutual surrender early-end file and accept or reject in writing the same day.

Can I clear the fridge before a court order?

No. Photograph sell-by dates if you have lawful access after a written access notice; leave goods where they are. Leftover-goods inventory starts after a lawful end and keys back — see the goods left behind inventory notice.

Does an abandonment notice on the door end the tenancy?
