How to File an ADGM Lease on AccessRP as the Landlord

AccessRP is the Abu Dhabi Global Market platform for leases on Al Maryah Island and Al Reem Island. The copy kept on the unit is the lease the lessor lodged there, not the signed PDF and not a Tawtheeq checklist. The landlord pays the registration fee AccessRP shows at filing. For a short-term residential lease, keep the counter-signed condition report with that copy. Store the lodged lease and the receipt on the unit.

The lease for a unit on Al Maryah Island or Al Reem Island is signed, and the folder still holds the signed PDF plus a forwarded checklist for Tawtheeq, Abu Dhabi's municipal tenancy register. That PDF is not the lease the lessor lodged on AccessRP. AccessRP does not accept a Tawtheeq upload. Ejari, Dubai's tenancy register, a Tawtheeq renewal, and a Tawtheeq closure are other files. The lessor starts Lease Agreement Registration and keeps the lodged copy on the unit.

The signed PDF is not the lodged AccessRP lease

AccessRP is the platform the Abu Dhabi Global Market (ADGM) uses for real-estate services on Al Maryah Island and Al Reem Island. The lessor typically starts lease registration. The tenant reviews the application and approves it. The Registration Authority accepts registration applications for interests in that jurisdiction under the ADGM Real Property Regulations. The AccessRP guidance covers who starts the registration, and the Registration Authority states the same islands on its real-estate services page.

The copy that belongs on the unit is the lease lodged through that service. The PDF the parties signed is the contract they agreed. The unit keeps the copy AccessRP holds after the lessor registers it. A checklist forwarded from a Tawtheeq file, the pack used on TAMM or DARI, does not register that lease. On AccessRP the lessor finds the unit and the tenant. A Tawtheeq upload does not take the place of that registration.

A unit elsewhere in Abu Dhabi uses the municipal register. The documents for that pack are the Tawtheeq registration file. A Dubai unit uses Ejari, and the document list for that register is the Ejari checklist. A renewal of a tenancy that already exists on Tawtheeq uses the renewal form for that existing tenancy. A Tawtheeq closure is a separate paper. An Abu Dhabi address is not automatically an AccessRP lease, and an Abu Dhabi lease is not automatically a Tawtheeq lease. AccessRP records cover Al Maryah Island and Al Reem Island.

For the lease to be registered, section 44 of the Real Property Regulations requires a description sufficient to identify each lot or part lot, a description sufficient to identify the lessor and the lessee, and the term. The parties are identified with addresses, contact details, nationalities, and a licence number where one applies. The term includes the commencement date and any option to renew, purchase, or expand that the lease already states. Those are the particulars on the section 44 rule page. A short-term residential lease also has to meet section 52.

The registration fee stays on the AccessRP application

The landlord is responsible for the lease registration fee on a commercial lease and on a residential lease. The amount is the amount AccessRP shows when the application is filed. Under the Real Property Regulations, the Registrar may charge registration fees and, in addition, a one-time service fee and annual authority fees. No dirham amount is given for those charges in the regulations or in the AccessRP guidance. The landlord pays the figure shown on the application.

Rent, deposits, repairs, and AccessRP's other lease services stay outside this copy. What the unit keeps is the registered lease and the receipt.

Outside this lodging

The landlord pays the registration fee, and the amount is the amount AccessRP shows at filing. Rent increases, security deposits, and repairs are separate from this lodging. Renewal, a variation, a surrender, and an expiry are other AccessRP services. A Tawtheeq registration pack, an Ejari registration, a Tawtheeq renewal, and a Tawtheeq closure are other files. The Premise ID, the address identifier on the tenancy contract, is not a sample number for this lodging, and updating it on another portal is a different task. Opening an account, paying from a wallet, and a service-centre visit are outside the copy kept on the unit.

One lodging, and the copy stays on the unit

The steps are one lodging for this unit, from the island and the signed lease through to the receipt. The condition report appears in that lodging only when the lease is a short-term residential lease. Section 52 requires that lease to be in clear and concise language and to include a condition report of the present repair and condition, including the lessor's furniture and equipment where the lessor provides them. The lessee counter-signs the report at handover, and a disagreement is annotated on the report. That page stays with the lodged copy. On any other lease, the report is not added.

For a lease other than a short-term residential lease, a memorandum may be registered in place of the complete lease when it includes the section 44 particulars. It cannot replace a short-term residential lease. Once both parties have approved, the receipt is stored with the lodged lease and the amount stays on the receipt.

Checklist for keeping the lodged copy on the unit

Lease Agreement Registration on AccessRP

  1. Confirm the island

The unit is on Al Maryah Island or Al Reem Island. AccessRP keeps the real-estate record for those islands. If the address is another unit in Abu Dhabi, stop and use the Tawtheeq registration file. If the address is in Dubai, stop and use the Ejari file.

  2. Use a lease that is already signed

Lease Agreement Registration starts after the lease is signed. Only the landlord or the landlord's representative can start the tenancy contract on AccessRP. The owner starts when no property-management agreement is active. A holder of a power of attorney may start for the lessor. The property-management company may start when a property-management agreement is active.

  3. Find this unit and this tenant

The lessor starts Lease Agreement Registration and finds that unit and that tenant on AccessRP. The tenant reviews and approves once the application exists. A Tawtheeq contract is not the paper this registration accepts.

  4. A commercial lease needs a valid licence

A commercial lease needs a valid ADGM commercial licence, and both the lessor and the lessee need a profile on AccessRP. The lease may start on a future date when that licence is valid and the new lease does not overlap a lease already on the same unit. The lease may still end after the licence expires.

  5. Keep the condition report with a short-term residential lease

When the lease is a short-term residential lease, keep the condition report with the lodged copy as a named page. The lessee counter-signs it at handover, including when the lessee disagrees, and the disagreement is annotated on the report. The lessor bears the cost of preparing that lease. The regulations state no dirham amount for that cost. A memorandum of lease cannot stand in for this lease.

  6. Particulars, then both parties approve

The lodged lease identifies the lot or the part lot, the lessor, the lessee, the term, and the commencement date. Identification of the parties includes addresses, contact details, nationalities, and a licence number where one applies. The term includes any option to renew, purchase, or expand that the lease already states. For a lease other than a short-term residential lease, a memorandum of lease may be registered instead of the complete lease when the memorandum includes those particulars. Both parties approve the lease. A power-of-attorney holder may approve for a party only when the power of attorney grants that authority.

  7. Store the receipt with the lodged lease

Once the fee is paid, download the receipt from the application and keep it with the lodged lease on the unit. The amount stays on the receipt. When the lease is a short-term residential lease, store the counter-signed condition report, including any annotated disagreement, with that lease and that receipt. For any other lease, the report is not part of this copy.

Stop when this unit holds the lease the lessor lodged on AccessRP, with the receipt stored beside it. The receipt carries the amount. The unit file does not add a fee figure, a dirham amount, a percentage, or a number of days. When the lease is a short-term residential lease, the condition report the lessee counter-signed at handover stays with that copy, including a disagreement annotated on the report.

If the paper in the folder is a Tawtheeq pack, it stays on the Tawtheeq registration file. If it is an Ejari registration, it stays on the Ejari file. If it is a Tawtheeq renewal, it stays on the renewal form for the existing tenancy. If it is a Tawtheeq closure, that confirmation stays on its own file. AccessRP renewal, a variation, a surrender, and an expiry are separate services.

IziRento stores the lodged copy and, where the lease is a short-term residential lease, the condition report. It does not file the lease on AccessRP, pay the registrar, or make the landlord compliant.
